SMS Premium Service Terms and Conditions

1. The Premium SMS number 199 OWNER (199 69637) is provided for the clients of thoroughbred horse trainers (owners) to receive their 'Trainers Say' reports and regular updates on their horses race campaign via their MISTABLE software.

2. How to Use this service

1. Owners are required to fill in the form provided in the "Edit User Details" section of the thoroughbred trainers MISTABLE website software. Owners can only subscribe to the service by filling out the form online. They cannot subscribe using any other method.
2. The form requires the owner to select what messages they would like to receive via SMS
3. Owners are then required to 'opt in' to receive premium rate sms messages. The following message is displayed;
4. To receive messages via sms you will need to 'opt in' for the service (below). Once you opt in and submit this page, a free sms message will be sent to you in which you will need to reply with 'YES', a second Free message will be sent to make sure you wish to continue and that you agree to the MISTABLE SMS Premium service and terms of service. If you reply with 'AGREE' your SMS service will start. Select which message you would like to receive via sms premium service at a cost of $2.00 per message.
   
5. There are five opt in options to select by clicking on the box marked yes beside each item. They include;
   1. Opt in for SMS
   2. Trainers Say alert
   3. Nominations alerts
   4. Acceptances alerts
   5. Scratching alerts
6. They then must click submit to confirm the 'opt in' process to receive MISTABLE SMS premium service alerts.
7. Owners will then receive alerts based on their selections and as often as the information they selected is released on the website. This maybe multiple times a day, week or month.

1. Messages will continue to be sent until an owner chooses to unsubscribe.
   To unsubscribe simply text 'STOP'; to 199 69637.

1. This Premium SMS service is charged at $2.00 per SMS update received (inc. GST). This will be charged to your mobile phone bill or pre-paid account.
   The charge will appear on your mobile phone bill under MISTABLE
2. Accuracy of Information:
   All competition data is provided by various third parties including Cyberhorse, and the individual trainers and their administrative staff and therefore MISTABLE cannot guarantee the accuracy of data. Any queries on the errors should be referred to the individual trainer who is providing the information.
3. Premium SMS Service availability:
   Your mobile plan must be able to accept a premium SMS service (most automatically do). If you are having difficulty subscribing to the service please check with your mobile phone provider.

6. Data Collection and Storage:
   Whenever you use our Premium SMS service, we automatically record the mobile number the date and time of your message.
   This information does not identify you personally. No attempt is made to identify you except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect our service provider's logs.
   This information is stored in a secure area within MISTABLE and only forwarded to appropriate staff so they can answer your questions. It will not be used for any other purpose without your consent.

5. Liability:

1. Use of the 199 OWNER (199 69637) SMS service is at your sole risk. If you rely on this service you are responsible for ensuring by independent verification the accuracy, completeness and timeliness of SMS message delivery.
2. MISTABLE does not provide legal advice.
3. General information is provided on the understanding that MISTABLE or it's parent company DEJODA do not accept liability for any loss or damage incurred by any person as a consequence of or in use, reference or reliance on this information shall be at the sole risk of that person who should seek the advice of their own legal representatives.
4. Carriage fees may also apply.
